Why this matters on your contract

An extension of time claim is decided by records created months before anyone writes it. The notice served within the contractual period. The baseline programme that was credible. The delay log kept while the delay was happening. Where those exist, a legitimate claim is usually approved. Where they do not, no amount of persuasive writing recovers it.

We prepare EOT submissions that demonstrate rather than assert: this event occurred on this date, notice was served here, the critical path moved by this many days, and this is the mitigation that was attempted. Where the record has gaps, we say so and build the strongest defensible position from what exists.

What the service includes

Delay event identification

Cataloguing of each delay event with date, cause, contractual entitlement category and supporting evidence.

Notice compliance review

Verification that notices were served within the contractual period, and assessment of the position where they were not.

Critical path impact analysis

Demonstration of how each event affected the driving path, using time impact or as-planned versus as-built analysis as appropriate.

Concurrency assessment

Honest analysis of concurrent contractor-caused delay, because an unaddressed concurrency argument will be raised against you anyway.

Mitigation evidence

Documentation of steps taken to mitigate, which is a requirement under most conditions of contract and frequently overlooked.

Claim submission pack

Complete submission with narrative, programme exhibits, evidence appendices and a quantified time entitlement.

Not necessarily. The consequence of late notice varies significantly between contract forms, and in some cases the entitlement survives with the burden of proof raised. Send us the conditions of contract and the correspondence and we will assess it honestly.

An EOT grants additional time and relieves liquidated damages. Prolongation costs are the additional money for extended site presence. They are separate entitlements — we prepare both, but the time claim must succeed first.

Typically three to six weeks depending on contract length and record quality. Where the baseline and as-built programmes must first be reconstructed, longer — that reconstruction is usually the bulk of the work.
